Welcome to PedigreeTool (the “Service”), a web-based pedigree drawing and visualization tool. The Service is owned and operated by PedigreeTool development team (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our Service.
1. Agreement to Terms
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
2. License and Permitted Use
We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service strictly for academic, educational, or research purposes, subject to these Terms. You agree that you will not:
a) Reverse engineer, decompile, or otherwise attempt to discover the source code of the Service.
b) Resell, redistribute, or sublicense the Service or any part thereof.
c) Use the Service for any purpose that is illegal or prohibited by these Terms.
d) Use the Service in violation of any applicable laws, including data protection and privacy regulations.
You are strictly prohibited from using profanity, obscene, discriminatory, harassing, or otherwise offensive language in your account details (including your submitted first and last name) or anywhere else within the Service. We reserve the right to immediately suspend or permanently terminate any account that violates this policy, at our sole discretion and without prior notice.
3. Beta Access and Trial Period
The Service is currently offered in a beta phase (“Beta Access”). The Service is available free of charge for evaluation purposes during this phase.
After this period, continued access to the Service will require a paid license. We will provide you with at least thirty (30) days’ notice via the email address associated with your account before any charges are applied for continued use.
3.1. SYNTHETIC DATA ONLY (Strict Beta Requirement)
During Beta Access, you are strictly prohibited from uploading, entering, or processing any real, identifiable patient data or Protected Health Information (PHI).
You agree to use only synthetic, anonymized, or dummy data for the purpose of testing the platform’s drawing, mapping, and export features.
4. Clinical Use Disclaimer
**THIS SERVICE IS NOT A CLINICAL DIAGNOSTIC TOOL.**
The Service is provided for informational, educational, and research purposes only. It is not certified, approved, or intended for clinical diagnostic use, including but not limited to patient care, medical decision-making, or any use where incorrect output could lead to personal injury or harm. You are solely responsible for validating the accuracy and appropriateness of any output generated by the Service.
5. Intellectual Property
All rights, title, and interest in and to the Service, including its design, layout, code, pedigree symbols, and all other materials, are and will remain the exclusive property of PedigreeTool and its licensors. The Service is protected by copyright, trademark, and other laws of the Netherlands and foreign countries.
You strictly retain all ownership, rights, and title to the synthetic data and pedigree structures you input into the Service (“User Data”).
6. Data and Privacy
Your privacy is important to us. Our collection and use of your personal information are described in our Privacy Policy. By using the Service, you acknowledge that you have read and understood the data practices described therein. You are solely responsible for the legality and security of any data you input into the Service.
7. Data Retention and Offboarding
If your trial expires, you choose not to subscribe, or your account is terminated, your account will transition to a “read-only” state. We will hold your User Data for thirty (30) days, allowing you to export your records. After this 30-day window, your data will become eligible for permanent and irreversible deletion from our servers.
8. HIPAA, GDPR, and Business Associate Agreements
Because this Beta Access is strictly for synthetic data, we do not currently offer or sign Business Associate Agreements (BAAs) or Data Processing Agreements (DPAs). Once we finalize our corporate incorporation and deploy enterprise security features (MFA, backups), we will lift the synthetic data restriction and offer BAAs/DPAs for institutional clients.
9. Warranty Disclaimer
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PEDIGREETOOL, ITS AFFILIATES, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR (D) ANY UNAUTHORIZED UPLOAD OF REAL PATIENT DATA OR PHI IN VIOLATION OF SECTION 3.1.
11. Indemnification
You agree to defend, indemnify, and hold harmless PedigreeTool and its employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice, for any reason, including for a breach of these Terms. Upon termination, your right to use the Service will immediately cease.
13. Changes to Terms
We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by updating the “Effective Date” at the top of these Terms and, in some cases, we may provide additional notice (such as by sending you a notification). Your continued use of the Service after any modification constitutes your acceptance of the new Terms.
14. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
